Welcome to Cellesim. By purchasing or using our services, you agree to these Terms. These services are provided by Cellesim, LLC, located in Newark, Delaware, United States.

• Sanctions Policy: In compliance with OFAC regulations, our services are not available to residents of, or persons located in, sanctioned countries/regions including but not limited to Iran, Russia, North Korea, Syria, Cuba, and the Crimea region. Any transaction attempted from these regions is strictly prohibited, will be blocked, and is non-refundable.

Service Description

Cellesim provides prepaid eSIM (embedded SIM) connectivity solutions.

• The service is purely digital; no physical goods are shipped.
• Delivery is immediate via email (QR Code) automatically upon payment.

Device Compatibility

& User Responsibility

• Compatibility: You acknowledge and agree that your device must be eSIM-compatible and Carrier-Unlocked to use our services.
• Verification: It is the user's sole responsibility to verify device compatibility before purchase. Cellesim is not responsible for refunds if the device is locked or incompatible.

Pricing & Payments

• Payments are processed securely via third-party providers (Stripe, PayPal, etc.).
• Prices are final and include applicable taxes unless stated otherwise.
• Fraud & Chargebacks: Fraudulent chargebacks or opening disputes for valid, delivered services will result in a permanent ban of the user's account and device from our services. We reserve the right to report such incidents to global fraud protection databases.

Validity & Activation

Policy

• Start Date: The validity period of the data plan begins strictly when the eSIM connects to the network in the destination country (unless stated otherwise in the plan details).
• Expiration: eSIMs must be installed and activated within the specified timeframe (usually 6 months from purchase) to remain valid.

Refunds & Cancellation

• Digital Goods Waiver: Since the eSIM is a digital product, by purchasing, you acknowledge that you waive your right to a cooling-off period (right of withdrawal) once the QR code is delivered via email, as the performance of the contract has fully begun.
• Refundable: Refunds are issued only for technical failures caused by Cellesim that cannot be resolved by our support team.
• Non-Refundable: Locked phones, user errors (e.g., deleting the eSIM), installing on the wrong device, or changing your mind after delivery are not eligible for refunds.

Limitation of Liability

Cellesim acts as a reseller and does not guarantee uninterrupted coverage due to factors outside our control, such as geography, local provider maintenance, weather conditions, or network congestion.

Governing Law

These Terms are governed by and construed in accordance with the laws of Delaware, United States. Any disputes arising from these Terms will be resolved in the courts of Newark, Delaware.

VPN Acceptable Use

Cellesim offers a free virtual private network (VPN) as a value-added benefit for customers with an active eSIM. The VPN is provided "as is" and "as available", without any guarantee of uptime, speed, or specific server locations, and may be modified, suspended, or discontinued at any time.

• Eligibility: VPN access is limited to customers with an active, eligible eSIM. Access keys are personal, are tied to your eSIM, and may not be shared, resold, or transferred.
• Lawful use only: You agree to use the VPN solely for lawful personal purposes and in compliance with all applicable laws, including the laws of the country from which you connect.
• Prohibited activities: You may not use the VPN for any illegal activity, including copyright or intellectual-property infringement, distribution of malware, hacking or unauthorised access to systems, spamming, fraud, harassment, distribution of illegal content, or any activity that harms our network or other users.
• No abuse: Automated, excessive, or abusive traffic that degrades service for others, attempts to circumvent capacity limits, or is used to run servers, proxies, or commercial redistribution is not permitted.
• Enforcement: We may suspend or permanently revoke VPN access, without notice or refund, if we reasonably believe these rules have been breached. Because the VPN is a free benefit, suspending it does not affect your paid eSIM data plan.
• Legal compliance: The VPN is not intended to shield unlawful conduct. We cooperate with valid legal requests from competent authorities to the extent required by law.
